作者簡介

康大安,是美國芝加哥馬歇爾法學院教授。她不僅以優異的成績從加利福尼亞大學伯剋利分校( the University of California at Berkeley)獲得瞭文學士學位,而且還從耶魯大學法學院( the Yale Law School)獲得瞭法學博士學位。她還曾擔任耶魯法律評論( the Yale Law Review)的編輯。在2005年至2009年間,康大安教授還多次到我國的北京和吉林等地進行授課。

Article IH establishes the Judiaal Branch as a separate and equal branch of the federal government. Article III creates the United States Supreme Court (although Article I gives Congress the power to establish the lower federal court system) and sets forth the powers of the federal judiciary to interpret and apply laws to individual cases.
The constitutional distribution of governmental powers among the Legislative, Executive, and judicial Branches is based on the "Separation. of Powers Doctrine. "The purpose of distributing government powers among three separate branches is to prevent any one branch,or any one person, from becoming too powerful. Under the "Checks and Balan.ces Doctrine," each branch has the constitutional power to check (counteract or restrain) the initiatives of any other branch. For example, Congress has the power to pass a law but the President has the power to veto (reject) the law, and the Supreme Court has the power to declare the law unconstitutional. Consequently, the three branches must cooperate with each other to accomplish their legislative, executive, and judicial functions.
The Constitution also divides power between the federal government and the individual states. The division of powers between a central government and numerous regional governments is called federalism. Under the American system of federalism, the states have relinquished many sovereign powers to the federal government in exchange for such benefits as domestic order, national security, a unified monetary system, and a nationally regulated system of interstate commerce. The states, as separate political entities, have retained control over local matters arising within their geographic borders such as law enforcement, education, family relations, and business regulation.
